ABSTRACT

The article presents the results of the analysis of the non-monetized criteria use for evaluating applications in competitive procedures and their application in 2017 when implementing federal targeted programs activities in the fi eld of education. Practical recommendations on algorithms for calculating non-monetized evaluation criteria indices that provide transparency of the procurement procedures and increase the evaluation of bids objectivity are formulated.

В соответствии с Федеральным законом от 05.04.2013 № 44-ФЗ «О контрактной системе в сфере закупок товаров, работ, услуг для обеспечения государственных и муниципальных нужд» (далее — Закон о контрактной системе) для оценки заявок, окончательных предложений участников закупки заказчик в документации о закупке устанавливает критерии оценки. Оценка — процесс выявления поставщиков (подрядчиков, исполнителей) в соответствии с условиями определения, по критериям оценки и в порядке, установленном в документации о закупке в соответствии с требованиями Правил оценки заявок, окончательных предложений участников закупки товаров, работ, услуг для обеспечения государственных и муниципальных нужд, утвержденных Постановлением Правительства Российской Федерации от 28.11.2013 № 1085 (далее — Постановление Правительства РФ от 28.11.2013 № 1085) [5], лучших условий исполнения контракта, указанных в заявках (предложениях) участников закупки, которые не были отклонены. В соответствии с Постановлением Правительства РФ от 28.11.2013 № 1085 [5] критерии оценки делятся на две группы, характеризующиеся как стоимостные критерии оценки (далее — стоимостные критерии) и как нестоимостные критерии оценки (далее — нестоимостные критерии). Если с ценовыми критериями все просто — расчет производится в соответствии с формулами, представленными в Постановлении Правительства РФ от 28.11.2013 № 1085, то при использовании неценовых критериев возникает много вопросов. Рассмотрим следующие нестоимостные критерии, используемые при закупках работ (услуг) в сфере образования, и практику их применения в 2017 г.:
 критерий «Качественные, функциональные и экологические характеристики объекта закупки»;
 критерий «Квалификация участников закупки, в том числе наличие у них финансовых ресурсов, оборудования и других материальных ресурсов, принадлежащих им на праве собственности или на ином законном основании, опыта работы, связанного с предметом государственного контракта, и деловой репутации, специалистов и иных работников определенного уровня квалификации».
