The problems of realization of the international standards in the sphere of protection of the rights and freedoms of a person and a citizen by the available facts of application of tortures during pretrial proceedings and during serving a criminal sentence in correctional institutions of the Republic of Kazakhstan are considered. There are the following roblems: using of terminology; determination of the sum of compensation for victims of tortures; legislative regulation of payment of compensation in case of absence of defendants, including for application of tortures. The compensation sum is offered and the legislative mechanism of payments to the victims of crimes is reasoned.
