Now the problem of realization of criminal liability for commission of the majority of the economic crimes encroaching on the interests of the state takes place. The compelled refusal of law enforcement and judicial authorities of appropriate response to socially dangerous acts made in various sectors of the Russian economy leads to emergence of threat of causing essential harm that is officially announced at the top-level government determining modern strategy of national security of Russia.Economic security of any state represents set of safety in various sectors of economy: industry, transport and so forth. In this case, agriculture plays a great role because this sector of economy is designed to ensure food security of the population of the country. It is impossible to overestimate value of the Russian agrarian and industrial complex, especially in modern conditions: that is, domestic agricultural producer must solve a food problem in the conditions of the international sanctions policy concerning economic entities of the Russian Federation. In this regard a solution of the economic relations protection problem as well as state interests in the sphere of an agrarian and industrial complex including criminal and legal means is essential for future of Russia. Much attention is payed to quality of criminal and legal instructions according to which the look and the amount (term) of criminal penalty are defined.Due to the numerous violations of the rules of the legislative equipment allowed at formulation of standards of the criminal law, including responsibility for the crimes encroaching on economic security, courts are forced to impose the sentences obviously not corresponding to high public danger of the specified acts. It, in turn, convinces guilty of impunity for the committed crime that it provokes growth of economic crime in all spheres of the Russian economy.The presented system of sanction creation rules of criminal-law normsconcerning responsibility for some crimes encroaching on the state interests in the sphere of an agrarian and industrial complex will allow to provide appointment and real execution of just punishments corresponding to high public danger of economic crimes. In general the offered option of rulemaking activity will promote effective counteraction of economic crime in the Russian Federation.
