Currently, suspended sentence is the most commonly used measure of criminal law. This measure is not a punishment, as it is not included in the system of punishment types. The role of suspended sentence and its place in criminal legislation of Russia has changed: tightening of penal policy of the state led to wider use of shortterm imprisonment, easing of criminal policy led to increased use of probation. The article studies the legal nature of suspended sentence in the criminal law of Russia and Mongolia, for this purpose the most common points of view on this issue are analyzed. It is concluded that suspended sentence by its legal nature is a punishment, since it contains all the signs of punishment, fully realizes its goals, has a common essence with punishment and correction, which are contained in the deprivations and restrictions of his rights and freedoms applied to a suspended sentenced person.
