ABSTRACT

The article considers and analyses stipulated in the criminal procedural law the possibility of gathering evidence by the defender. It is concluded that the defender is not subject to collecting of proofs in the Russian criminal proceedings. Reveals the specific problematic issues of the participation of the defense in proving. The author comes to the conclusion about the imperfection of the legal framework governing the participation of the defender in terms of the gathering and presentation of evidence during the prosecution. Position protection in the Russian criminal trial to be to refute the charges, only through "procedural critics" of the evidence presented by the prosecution.
