The article analyzes Russian legislation regulating the field of mediation. Mediation is a relatively new phenomenon for civil relations. Currently not yet established as regulatory mechanisms that would adequately provide law enforcement practices within the designated service. Not fully settled the liability of the mediator as by services. Not established clear criteria to the service, including the actions of the mediator. There is no uniformity in judicial practices affecting the field of mediation. Moreover, to date, no clear mechanisms that would allow to characterize the legal nature of mediation as a form of compensated service. In the relationship between the mediator and the client are spaces right. Does not address the responsibility of the customer, as a party to the relationship in the agreement on mediation. Despite the fact that the client in the mediation procedure acts as customer reimbursable services, the legislator has not considered such signs specified transaction, its fiduciary component. Given these gaps, mediation as a kind of civil legal services, requires a theoretical analysis.
