The problem of compensation for moral damage, first of all, is in the facts: the relations to determine the size and the conditions of compensation for moral damage are not adequately regulated in the national legislation, as well as; there are not sufficient legal forms within which the given institute will be developed. In this article the authors attempt to examine the issues arising from the liability for damage done to non-property rights and intangible (non-material) benefits. The author proposes to distinguish the individual components that make up the category of «moral damage». On the basis of personal examination the author justifies the recommendations to improve the acting legislation and its application practice in the sphere of non-property rights and intangible (non-material) benefits’ protection.
