ABSTRACT

According to amendments as per Federal Law № 265-FZ of July 29, 2017, article 28.3, part 2, item 1 of the Administrative Offence Code Of The Russian Federation (hereinafter - AOC of RF), officers of law enforcement bodies (the police) are given the right to draw up a report on administrative offence as per article 14.17.1. Yet, it is the judges that are authorized to bring on cases of this type. Due to the relatively small number of legal precedents as per article 14.17.1 of AOC of RF and the public consequence of illegal alcohol distribution issue, the subject matter is deemed pressing. The article analyzes elements of this administrative offence and its demarcations from the comparable criminal offence. A list of a police officer's actions upon establishing a fact of illegal alcohol distribution by private individuals is proposed, as well as recommended recording procedures for this kind of civil injury.
